1. Rotary Dictionary Presentations: The Ontario-Walworth Rotary will be making its presentation of dictionaries to third graders at Freewill Elementary on March 3 during their assembly at 2:30 p.m. Any board member who would like to come and show their support of the Rotary efforts is encouraged to attend. This is the fourth year the Rotary has made this donation to the students of our district. They will be making their presentation to the OE students in late March.
2. Gullace Settlement Update: I have attached additional information received this week from Harris Beach. It is primarily a summary of our recent meeting and our relationship with them. Also included is a copy of the resolution passed by the Ontario Town Board stating that they will include all entities in the decision making for the remainder of the settlement process regarding the Gullace properties.
3. Susan Brown Comments: Attached are the comments from Susan Brown from the February 9 board meeting for your information.
4. Retiree Death: A long time teacher and Walworth resident, Hazel Bassage, passed away at age 95 recently. She taught in our district for many, many years, starting in a district rural school house then going to various Walworth schools and the Walworth High School, the old Ontario High School (OE), the Beneway High School and eventually retired from Wayne Middle School as a math teacher.
5. Past Board Member Death: Some of you may recall a past board member, Bill Quinn that recently passed away. He had left the area not too many years ago and moved back to Buffalo where he was originally from. He lost a battle with a host of cancers after a year long fight at the age of 63. He served on the Board of Education from 1981-1990 including terms as president and vice president.
6. Sectionals: We had two wrestlers qualify for states in the super sectionals this past weekend. They are Josh Patterson (senior) and Ryan Lamagra (junior). The boys and girls basketball teams were both eliminated in the first round of sectional play, but made a good showing.

A special meeting of the Ontario Town Board was called to order by Supervisor Molino at 1:07 PM in the Ontario Town Hall. Present were Supervisor Joseph Molino, Council members: Lori Eaton-Smith and James Switzer, Sole Assessor Eileen Perkins, Town Attorney Patricia Crippen and Town Clerk Cathy Herzog.
Absent: Council members Donald Shears and Jason Ruffell
Four residents and visitors including school representatives and special legal counsel were present at portions of the meeting.
Mr. Switzer led the Pledge of Allegiance.
Executive Session - A motion was made by Mr. Switzer, seconded by Mrs. Smith, to move into an executive session at 1:08 PM for pending litigation. 3 Ayes 0 Nays 2 Absent (Ruffell & Shears) MOTION CARRIED

A regular meeting of the Ontario Town Board was called to order by Supervisor Molino at 7:00 PM in the Ontario Town Hall. Present were Supervisor Joseph Molino, Council members: Lori Eaton-Smith, Jason Ruffell, Donald Shears and James Switzer, Superintendent of Water Utilities Robert Wykle, Superintendent of Highways William Slocum, Director of Recreation & Parks William Riddell, Sole Assessor Eileen Perkins, Library Director Karina Churchill, Dog Control Officer Mark Plyter, Town Clerk Cathy Herzog.
Absent: Building Inspector/Code Enforcement Officer Edward Collins, Accounting Supervisor Lois Buckalew and Town Attorney Patricia Crippen.
Eleven residents and visitors were present at portions of the meeting.
Mr. Shears led the Pledge of Allegiance.

Mr. Slocum reported on vandalism that was done on New Street to mailboxes. He stated his department has done extensive work on the sweeper truck that saved the town a considerable amount of money.

Mr. Switzer congratulated Mrs. Perkins on her certificate from the New York Office of Real Property Services for Excellence in Equity. Assessors who provided fair and equitable assessments and qualified for State Aid for five years since the program’s inception in 1999 received the award.
Ontario Public Library - A motion was made by Mr. Shears, seconded by Mr. Switzer, to accept the January 2006 Library report as presented. 5 Ayes 0 Nays MOTION CARRIED
Ms. Churchill announced she will be going to Albany to meet with local legislators to obtain Library funding that was promised but was not received. She stated a petition of support is available in the Library.
Mr. Floyd Welker, a member of the Library Board of Trustees, introduced the newest member Dennis Bielewicz. He stated Mr. Bielewicz is a retired Librarian from the Fairport School District, and he has been very active in the community. Mr. Welker added they are very pleased to have his commitment to our Library with his outstanding credentials.
Ontario Town Court – A motion was made by Mrs. Smith, seconded by Mr. Shears, to receive the January 2006 report as presented. 5 Ayes 0 Nays MOTION CARRIED
Dog Control Officer – A motion was made by Mr. Shears, seconded by Mr. Ruffell, to accept the January 2006 report as presented. 5 Ayes 0 Nays MOTION CARRIED

Mr. Riddell reported on the downtown revitalization project. The level of the project will be dictated by the level of funding received.

New Business – A motion was made by Mr. Shears, seconded by Mr. Switzer, to accept and file the Town Clerk’s summary of taxes report for taxes collected as of February 6, 2006, as presented.

A motion was made by Mr. Molino, seconded by Mr. Switzer, approve a change in the cleanup schedule to have one annual event in the spring for three days rather than two times a year and to authorize the Superintendent of Highways to seek bids for an Annual Spring cleanup scheduled Thursday May 11th , from 7:00 AM - 6:00 PM, Friday May 12th, from 7:00 AM - 6:00 PM and Saturday May 13th , from 7:00 AM - 4:00 PM, and to further authorize the Town Clerk to post and publish a legal notice for bidders, as requested by the Superintendent of Highways in Memo 06-01. 5 Ayes 0 Nays MOTION CARRIED
A motion was made by Mrs. Smith, seconded by Mr. Shears, to declare surplus office equipment including four (4) dell monitors and one (1) fax machine and authorize the Building Inspector to dispose of them, as requested by the Justice Court Department in a memo dated February 3, 2006.

A motion was made by Mr. Switzer, seconded by Mrs. Smith, to adopt a RESOLUTION to
SET A PUBLIC HEARING ON PROPOSED LOCAL LAW #2 OF 2006
WHEREAS, the Town Board for the Town of Ontario has determined that the Town’s Recreation and Parks Advisory Board’s membership should be increased from five to seven persons; and
WHEREAS, it appears that the original Recreation and Parks Advisory Board was established by local law; and
WHEREAS, it therefore, is necessary that a local law amend the law to increase the membership; and
WHEREAS, a proposed Local Law # 2 of 2006 has been prepared and examined by the Board and is presently on file with the Town Clerk of the Town of Ontario; it is therefore
ORDERED, that a Public Hearing shall be held before the Town Board for the Town of Ontario at the Town Hall located at 1850 Ridge Road, Ontario, New York on the 13th day of March, 2006 at 7:00 PM to consider the passage of Local Law # 2 of 2006 and to hear all persons interested in the subject matter thereof; and it is further

A motion was made by Mr. Switzer, seconded by Mr. Shears, to approve the MRB Group engineering proposal for Professional Global Positioning System (GPS) and Global Information Services (GIS) for an amount not to exceed $70,100.00 and authorize the Supervisor to execute the proposals as presented, as requested by the Superintendent of Water Utilities in Memorandum #01-2006. 5 Ayes 0 Nays MOTION CARRIED
A motion was made by Mrs. Smith, seconded by Mr. Shears, to authorize the Director of Recreation, William Riddell, to attend the National Parks and Recreation Association mid-year conference, February 15-17th in Washington D.C. with all necessary and actual expenses to be paid by the NYS Association of Recreation and Parks with no direct cost to the Town of Ontario, as requested by the Director of Recreation in Memorandum #PR2-2006. 5 Ayes 0 Nays MOTION CARRIED
A motion was made by Mr. Shears, seconded by Mr. Switzer, to authorize the Superintendent of Highways and Crew Chief Robert Fenn to attend the Annual Highway School on June 4-7, 2006 at Ithaca, NY with all actual and necessary expenses to be a town charge, as requested by the Superintendent of Highways in Memo # 06-02. 5 Ayes 0 Nays MOTION CARRIED
A motion was made by Mr. Shears, seconded by Mr. Switzer, to table a motion to authorize the Superintendent of Highways to purchase a 2006 Dodge pickup truck at NYS contract #PC60922.

A motion was made by Mr. Molino, seconded by Mr. Ruffell, to authorize the Superintendent of Highways to place an order for the purchase a 6 wheel dump truck from NYS bid contract with financing to come from HR5 - Highway Equipment Fund, $60,000.00 and the balance to come from the Highway Fund Balance, as requested by the Superintendent of Highways in Memo # 06-04.

Mr. Slocum reviewed the EPA regulations that will be coming into effect and the changes in the price of a 6 wheel dump truck in the future. He stated in the next four or five years the town will have to budget for the replacement cost for these vehicles.
A motion was made by Mr. Switzer, seconded by Mr. Ruffell, to adopt a RESOLUTION
GULLACE VS TOWN OF ONTARIO
WHEREAS, certain court cases remain pending in Wayne County Court regarding tax assessments commenced by Dante and Ralph Gullace and Orchard Grove Park, LLC against the Town of Ontario and its assessing authorities; and
WHEREAS, a Stipulation and Consent Order having been agreed upon between the Town of Ontario and the Petitioners for tax years 1998, 1999, 2000, 2001 and 2002; and
WHEREAS, a meeting between the Town of Ontario, county of Wayne and Wayne Central School District having been held regarding all such matters;
NOW, THEREFORE, IT IS HEREBY RESOLVED that the Town Board of the Town of Ontario hereby agrees to consult with the County of Wayne and the Wayne Central School District prior to entry into a settlement of the assessment questions for the tax years preceding 1998 and those after the tax year 2002; and it is further
RESOLVED, that the Town Board for the Town of Ontario shall come to an agreement with the County of Wayne and the Wayne Central School District on any settlement of the remaining tax years prior to settlement of the same. Dated February 13, 2006 5 Ayes 0 Nays RESOLUTION ADOPTED

Appointments/Resignations –A motion was made by Mr. Shears, seconded by Mrs. Smith, to appoint Cathy Herzog as the voting delegate for the Town of Ontario at the Annual Business Session of the Association of Towns of the State of New York meeting on February 22, 2006.

A motion was made by Mr. Shears, seconded by Mr. Switzer, to appoint Dennis Bielewicz to the Library Board of Trustees for a five year term ending December 31, 2010. 5 Ayes 0 Nays MOTION CARRIED
Reports by Town Board Members – Mr. Molino stated on behalf of the Ontario Town Board he extends sympathy to the family of Roger Corwin and condolences to his brother Richard Corwin who works for the Recreation Department. Mr. Roger Corwin worked for the Highway Department for 10 years and Mr. Molino stated he served the Town very well. The Town Clerk was directed to send a letter of condolences to the family on behalf of the Town Board.
Mr. Switzer reported that Wayne County Industrial Development Agency held a public hearing for Ariel Optics, Inc, a manufacturing company of precision optical components. Mr. Fred Koch requested agency financial assistance in the form of exemption from taxes.
Mr. Ruffell stated he is still drafting changes for the Comprehensive Plan and asked Mr. Molino to schedule time at the next Town Board workshop for this matter.
Mr. Switzer announced a water department employee, Andrew Kujawski, will be deployed to Iraq. He stated he is preparing a policy amendment for benefits for persons on military leave.
Approval of Claims - A motion was made by Mr. Switzer, seconded by Mr. Shears, to approve the abstract of claims for the month of February 2006, including vouchers # 211 through #356 with a grand total of $327,082.02 and to authorize the Supervisor to issue payments for same. 5 Ayes
