Greetings from Wayne Central School District. Below are some items of interest.
 
Newsletter:
 

1. French Trip – Attached is a requested trip to Quebec for February 2004 with our High School French Classes. I have approved this trip request and am attaching the information on the activities that will be included

 

2. Disciplinary Appeal - We have received an appeal of a recent superintendent’s hearing. This is pretty unusual but does occasionally occur. Their attorney, Mrs. Berkowitz, will be sending you a brief which I will be asking you to review at our next Board meeting. I will also provide you details of the situation at that time.

   

3. Informal Grievance - Human Resources Director, Mark Callahan is meeting with CSEA officials this afternoon about an informal grievance over the failure to hire back a 1-1 aide. Depending how that meeting goes it could become a formal grievance which would go to Mr. Atseff. If it wasn’t resolved there it would come to me and then to the Board. I will give you an update at our Board meeting.

 

4. Sectionals Update – Girl’s volleyball plays today at 5:00. Boy’s soccer is tonight at 7:00, football is Saturday at 3:00 and girl’s soccer is Saturday at 7:00. In addition to being the league champs we have learned that the Boy’s Varsity Soccer team have won the Wayne County Soccer Official’s Board - Sportsmanship Award. I don’t think you could have a much better team or coach than one that wins both those awards. By the way Tim Mattle is our coach.

 

5. Snow Days - Students saw their first snow fall last night and are wondering why I didn’t close. It seems early for snow. I think this could be a long cold winter.

I believe our meeting next week with Director of Social Services, Josh McCrossen, is another step in that process. Dear Don and members of the finance committee:
 
I would like to take this opportunity to formally introduce myself. I am Michael Havens, Superintendent of the Wayne Central School District and the new Chairperson of the Wayne County Superintendents’ Association. I have had the opportunity to meet and work with some of you in the past. Don, you may not recall, but you and I met at former Ontario Supervisor, Roy Hermann’s birthday party at the Ontario Country Club. We had a lively discussion about the sales tax (no surprise). For those of you who do not know, the Wayne School District encompasses most of the towns of Ontario and Walworth. We also include areas of Williamson, Macedon, Webster and Penfield.
 
I have reviewed the correspondence between our former chairperson, Rich Boyes, and your committee in order to begin familiarizing myself with the issues. I would like to continue our relationship with the committee as the new chairperson. We do have a common interest in the sales tax. I imagine it will bind us together, for better or worse, far beyond when any of us are able to walk the streets of Wayne County. During my term, I would like it to be for better. I note in the letters that you assured Mr. Boyes that we would be invited to all meetings at which the sales tax distribution would be discussed. I appreciate that courtesy and will assume we will continue to operate under those parameters unless you tell me differently.
 
I understand that Mr. Stitt finished his work with you and presented the information to the group. If there are any questions about that information for which you believe we could provide answers, please do not hesitate to contact me. Since I am new to this position I would like to make a special request that I come to a Finance Committee meeting to introduce myself and to get to know the committee members. I find that it is always easier to work with people to whom you can put a face and a handshake. I think the important point for all of us to remember is that we serve the same constituency with the same needs. While we may be charged with providing for different aspects of those needs, they remain the same people.
 
I look forward to working with you. I hope you will be agreeable to me introducing myself personally at one of your meetings.

ONTARIO TOWN BOARD MEETING
 

A regular meeting of the Ontario Town Board was called to order by Supervisor Clark at 7:30 PM in the Ontario Town Hall. Present were Supervisor Richard Clark Councilmen: Mark Brewer, Donald Camp, Ronald Fillmore, Donald Shears and Town Clerk Cathy Herzog.
 
The town hall was closed for the Columbus Day holiday and the Department Heads were excused from attending the meeting.
 
Three residents and visitors were present at portions of the meeting.
 
Mr. Shears led the Pledge of Allegiance.
 
Comments From the Public – None
 
Approval of Minutes - Mr. Clark asked for approval of the minutes of the September 22 and September 29, 2003 Town Board meetings. A motion was made by Mr. Camp, seconded by Mr. Shears, to approve the minutes with a correction on 9/22/03, page 5, under Town Board Reports change Mr. Shears birthday from “9/22” to “9/21”. 3 Ayes 0 Nays 2 Abstained (Brewer & Fillmore) MOTION CARRIED
 
CorrespondenceThe Town Clerk received the following correspondence:
 
NYS Comptroller teleconference “Where’s the Money?” finding funds for public water and sewer projects, to be held Wednesday October 22, 2003, registration forms available in the town clerk’s office
 
The amount of uncollected water and sewer to be added to the 2004 tax levy is $122,045.21 with $66.00 going to the Webster tax roll and $121,979.21 on the Town of Ontario tax roll. The re-levy list has been presented to the Assessors.
 
A motion was made by Mr. Camp, seconded by Mr. Brewer, to accept and file the correspondence.

Mr. Clark stated he asked the Fire Chief if there were any problems with water pressure on Friday evening when the Yankee Peddlers Bookstore and New York Pizzeria burned down on Main Street.
He was told there was plenty of water and the pressure was fine.
 
Superintendent of HighwaysA motion was made by Mr. Shears, seconded by Mr. Camp, to accept the September 2003 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Shears and Mr. Clark commented on the heavy volume of work done by the Highway Department. They thanked the Superintendent of Highways, William Slocum and the town highway employees for all the work they have done and for the extra time they put in for the annual town cleanup. And they thanked the highway personnel who are volunteers and assisted during the fire. Mr. Clark added he saw Mr. Slocum (fireman) and some of the highway crew cleaning up downtown after the fire.
 
Mr. Clark thanked all the firemen, police, emergency squad, town personnel and everyone involved with fighting and cleaning up after the fire.

Mr. Shears stated the landscaping project is looking very good at Memorial Point Park at Bear Creek Harbor and will look even better in the spring.

OCTOBER 23 – 31, 2003 AS RED RIBBON WEEK

 
WHEREAS, alcohol and other drug abuse in this nation has reached epidemic stages, and the 15-24 year old age group is dying from these causes at a faster rate than any other age group; and
 
WHEREAS underage drinkers consume 12% of all alcohol purchased in the United States; and the vast majority of this alcohol is consumed in a risky fashion (51% of 12-14 year-old drinkers binge drink; 65% of 15-17 year olds binge drink.); and
 
WHEREAS, it is imperative that visible, unified prevention education efforts by community members be launched to reduce the demand for drugs & alcohol; and
 
WHEREAS, the greater community and its representatives, both public and private, groups and individuals, will demonstrate their commitment to drug-free, healthy lifestyles by wearing and displaying red ribbons during a week-long campaign; 
 
NOW, THEREFORE BE IT RESOLVED that the Ontario Town Board hereby proclaims October 23 through October 31, 2003, Red Ribbon Week, and encourages our citizens to participate in drug and alcohol prevention education activities, making a visible statement that we are strongly committed to a drug-free community. 5 Ayes 0 Nays RESOLUTION ADOPTED
 
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to authorize the Superintendent of Water Utilities to seek bids for the purchase and installation of a new standby generator for the Ridge Road Booster Station and direct the town clerk to post and publish a legal notice to bidders, as requested by the Superintendent of Water Utilities in memo # 29-2003. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to set the wages for the elected officials for 2004 as follows: SUPERVISOR $43,680.00, TOWN CLERK $41,030.00 (includes Receiver of Taxes and Assessments), TOWN JUSTICE 2 @ $13,960.00, SUPERINTENDENT OF HIGHWAYS $51,490.00 and TOWN COUNCILMEN 4 @ $6,067.00. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to schedule the public hearings for the proposed 2004 budgets and contracts on Monday, October 27, 2003 at the Ontario Town Hall, 1850 Ridge Road, Ontario, New York to begin at 7:00 PM and to authorize and direct the Town Clerk to post and publish the legal notice of public hearings and the elected officials wages pursuant to Town Law. The Preliminary Budget is on file in the Town Clerk’s office for public inspection. 5 Ayes 0 Nays MOTION CARRIED
 
The legal notice to bidders for a mini excavator was posted and published in the Wayne County Mail on 9/25 and 10/2. The sole bid was properly presented and opened on Wednesday, October 8, 2003 at the Ontario Town Hall.
 
A motion was made by Mr. Camp, seconded by Mr. Shears, to award the bid for a 2003 John Deere 80C mini excavator to the sole responsible bidder, Five Star Equipment, Inc., bid price $87,950.00 less $17,000.00 for a net bid price of $70,950.00, as recommended by the Superintendent of Water Utilities in memo # 03-02. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Camp, seconded by Mr. Shears, to adopt a RESOLUTION to schedule a public hearing for PROPOSED LOCAL LAW #3 OF 2003
 
WHEREAS, the Town Board of the Town of Ontario has been presented with a Petition from the majority of residents and owners of Orchard Grove Village located within the Town of Ontario requesting that the Town Board adopt a local law setting a speed limit of 25 m.p.h. for the area;
 
WHEREAS, it appears that a local law is necessary to establish and enforce the requested speed limit; and
 
WHEREAS, a proposed Local Law #3 of 2003 has been prepared and examined by the Board and is presently on file with the Town Clerk of the Town of Ontario; it is therefore
 
ORDERED, that a Public Hearing shall be held before the Town Board for the Town of Ontario at the Town Hall located at 1850 Ridge Road, Ontario, New York on the 10th day of November 2003 at 7:30 P.M. to consider the passage of Local Law #3 of 2003 and to hear all persons interested in the subject matter thereof; and it is further

CARRIAGE COURT SUBDIVISION SEWER EXTENSION USER #16 (off Paddy Lane)
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to adopt a RESOLUTION
 

IN THE MATTER OF THE EXTENSION OF SEWER DISTRICT NO. 1 TO INCLUDE BENEFIT AREA NO. 16 IN THE TOWN OF ONTARIO, COUNTY OF WAYNE, NEW YORK
 
ORDER FOR PUBLIC HEARING
 

WHEREAS, a Petition dated September 28, 2003 having been duly presented to the Town Board of the Town of Ontario according to law requesting an extension of Sewer District No.1 to include User Benefit Area No. 16, hereinafter described; and
 
WHEREAS, the boundaries of the proposed User Benefit Area No. 16 are approximately 28.063 acres located off of Paddy Lane in the Town of Ontario commonly known as the Carriage Court Subdivision, as more fully set forth in a map annexed to the Petition herein; and
 
WHEREAS, the improvements proposed in the Benefit Area No. 16 consist of:
The construction of a sewer system with main and lateral sewers as more fully set forth in a map annexed to the Petition herein by the developer with the Town accepting the same as an extension of its Sewer District No.1; and
 
WHEREAS, the developer of the proposed improvements shall bear the costs of the same; and
 

WHEREAS, the following are the associated fees each user will be responsible for when a service is

connected:

a. Sewer Facility Fee: $1,250.00
b. Inspection Fee: $25.00
c. Sewer use fee/rate with operation, transmission, and maintenance $340.00 per year; and

 
WHEREAS, there will be no cost of the extension of the district to include User Benefit Area No. 16 to a typical property outside the extension; it is
 
ORDERED, that the Town Board of the Town of Ontario shall meet at the Town Hall located at 1850 Ridge Road, Ontario, New York on the 10th day of November, 2003, at 7:35 p.m. to consider the Petition and hear all persons interested in the subject matter thereof; and it is further
 
ORDERED, that the Town Clerk of the Town of Ontario is hereby authorized and directed to publish a certified copy of this Order in the Wayne County Mail and to post a copy of the same in the time and manner required by law. Dated October 13, 2003. 5 Ayes 0 Nays RESOLUTION ADOPTED

LEAD AGENCY RESOLUTION CARRIAGE COURT BENEFIT AREA

 
The Town Board of the Town of Ontario does hereby resolve as follows:
 
1. In accordance with the provisions of the New York State Environmental Quality Review Regulations, the Town Board of the Town of Ontario hereby makes the following determinations and classifications with respect to the extension of Sewer District No.1 to include User Benefit Area No. 16:
 
a. The Town Board hereby determines that the action is subject to SEQR;
 
b. The Town Board hereby determines that the action does not involve a federal agency or any other
     agency;
 
c. The Town Board of the Town of Ontario makes a preliminary classification of the action as an
unlisted action;
 

d. The Town Board of the Town of Ontario hereby determines that it will be the lead agency with

respect to the above Resolution for extension of Sewer District No. 1.
 
This Resolution shall take effect immediately. Dated October 13, 2003

Budget Transfers/Adjustments - A motion was made by Mr. Brewer, seconded by Mr. Camp, to approve the following budget transfers and adjustments:
Parkland Development Fund transfer of $10,000.00 from T-37 to H-65-03
Water Fund adjustment from 599/appropriated fund balance $16,000.00 to F 8340.2
Sewer Fund adjustment from 599/appropriated fund balance $16,000.00 to SS 8120.2
Sewer Fund S2 adjustment from 599/appropriated fund balance $16,000.00 to S2 8120.2

Reports by Town Board Members – Mr. Brewer extended thanks to the Firemen and Emergency personnel who responded to the fire on Main Street and to the surrounding Fire Companies who provided mutual aid to Ontario.
 
Mr. Brewer reported on the foreclosure proceedings at 1140 Ridge Road. The bank that bought the house paid the back taxes and they told him it will be listed with a realtor, fixed up and put on the market for sale. He has informed the neighbor, Mr. Deschambault, who has inquired about the property in the past.
 
Mr. Camp added his thanks to those who responded to the fire and he stated they couldn’t be praised enough for all they did.
 
Mr. Shears and Mr. Clark extended their appreciation again relative to the fire.
 
Mr. Shears reported that he and the Building Inspector, Ed Collins, are looking for storage areas for the Library in the Town Hall building. He also noted he and Mr. Collins have received an official complaint relative to the Noise Ordinance and they will be following up on that.
 
Mr. Shears stated Mr. Clark and he attended the Supervisor’s Secretary’s wedding, Katie Steinmetz. The day was beautiful and Katie was a lovely bride.
 
Mr. Clark announced Ontario will host a three-board meeting next Monday, October 20, 2003 at the Recreation Building in Casey Park at 7:30 PM. This will include the Ontario Town Board, Walworth Town Board and Wayne Central School. The meeting is open to the public.
 
Mr. Clark and Assessor, Eileen Perkins, had a conference call with prospective buyers of the Ginna Nuclear Power Plant and Deborah Wegman from Rochester Gas & Electric. Mr. Clark also reported on projects involving Russell Station and Ginna and an upgrade RG&E will be doing at the sub-station on the northeast corner at Slocum Road.
 
Approval of Claims - A motion was made by Mr. Brewer, seconded by Mr. Camp, to approve the abstract of claims for the month of October 2003, including vouchers # 2028 through # 2194 with a grand total of $136,267.33 and to authorize the supervisor to issue payments for same.
