Greetings from Wayne Central School District. Below are some items of interest.
 
 


Newsletter:
 

1. Retirement letter: I have received a retirement letter from Sandy Woodard. The effective date is next July. She gave it to me early so we would have plenty of time to find a replacement for the position. I will include the letter in the personnel action for October. As soon as you accept the resignation, we will post the position within the district. Mrs. Scheik will be one of the applicants. There could be others though I know of no one else at this time. I will have a committee conduct the initial interviews and bring my recommendation to you by January 1st. The first task of the new director will be to do an audit of the operations and to make recommendations to me regarding improvements to the operation we should consider.

 

2. Wayne County Mail Picture: I wasn’t sure if you had seen the pictures of our Board member. If you look carefully you can see her in both photographs.

 

3. Uniforms: Uniforms were discussed at a recent Board meeting. As promised I have enclosed some articles on the subject. Some of the first articles are very technical in their writing. The later ones are not quite so bad. Taken together I think you will find them interesting.

 

4. Article From Literacy Volunteers: This was an interesting piece about our students written by the director of Literacy Volunteers. As I have often said, people complain about today’s youth. It’s too bad about their kids but I think ours are pretty wonderful.

 

5. But they do mess up sometimes: Three of our soccer players were investigated by the police for knocking down mailboxes, throwing eggs and doing other mischievous things over the course of the last two months. The school investigated and concluded the allegations were true. The three players have been suspended from the team.

 

6. School Play: I met with the directors and producers to the school play. I am very pleased with the enthusiasm they showed. Right now they are considering Singin’ in the Rain, Beauty and the Beast, and Annie Get Your Gun. Their preference is Beauty and the Beast if it is available. As a part of Model Schools we started a drama club this year. Currently we have over 40 members. I am very optimistic that we are on the right track with our program.

 

7. Ginna: Just a reminder that under the confidentiality agreement we can not yet say anything about the Ginna agreement. You may get questions from the public. You can say that we are close to an agreement but you haven’t seen nor approved anything yet.

ONTARIO TOWN BOARD MEETING
 

A regular meeting of the Ontario Town Board was called to order by Supervisor Molino at 7:30 PM in the Ontario Town Hall. Present were Supervisor Joseph Molino, Councilmen: Mark Brewer, Donald Camp, Ronald Fillmore, Donald Shears and Superintendent of Highway William Slocum, Superintendent of Water Utilities Robert Wykle, Director of Recreation & Parks William Riddell, Accounting Supervisor Lois Buckalew, Sole Assessor Eileen Perkins, Assistant Library Director Nancy Obaid, Dog Control Officer Mark Plyter, Chairman of the Watershed Management Advisory Council Allan Tyo, Town Attorney Patricia Crippen and Town Clerk Cathy Herzog
 
Absent: Building Inspector/Code Enforcement Officer Edward Collins,
 
Twenty-five residents and visitors were present at portions of the meeting.
 
Mr. Fillmore led the Pledge of Allegiance.
 
Comments From the Public – Mr. Christopher Breed, 1400 Ridge Road, presented a petition “related to public safety” asking for a lower speed limit on Ridge Road west of the intersection Route 350 to extend the 30 M.P.H. speed zone starting at 1400 Ridge Road to the intersection of Slocum Road.
 
There was a discussion on the increased vehicle traffic in that area, the two new roads from and additional population from the Gerber development increased pedestrian traffic and the number of signatures and residents in the area of the proposed change.
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to adopt a RESOLUTION
 
REQUESTING A REDUCTION FROM THE ESTABLISHED 45 M.P.H. SPEED LIMIT
TO 30 M.P.H. ON RIDGE ROAD (COUNTY HIGHWAY) FROM ROUTE 350
WEST FROM 1400 RIDGE ROAD TO THE INTERSECTION OF SLOCUM ROAD
 
RESOLVED, that the Ontario Town Board does, pursuant to SS1622.1 of the NYS Vehicle and Traffic Law, hereby request the Wayne County Superintendent of Highways to request the NYS Department of Transportation establish a lower maximum speed limit of 30 M.P.H. at which vehicles may proceed on Ridge Road in the Town of Ontario, NY.
 
The Town Clerk is authorized and directed to forward a certified copy of this resolution and a copy of the petition to the Wayne County Superintendent of Highways. 5 Ayes 0 Nays RESOLUTION ADOPTED
 
Approval of Minutes - Mr. Molino asked for approval of the minutes of the August 23, 2004, Town Board meeting. A motion was made by Mr. Camp, seconded by Mr. Brewer, to approve the minutes with a correction on page 2, paragraph 8, a Highway budget transfer, change
“DA 513.4” to “DA 5130.4”. 5 Ayes 0 Nays MOTION CARRIED

Town Attorney ReportMs. Crippen reported she has reviewed the town board minutes in regard to the HR1 Capital Reserve Fund and she found that when it was established in 1960 and when it was amended in 1980 it was subject to permissive referendum. In order to expend funds from the Capital Reserve fund it is not necessary to subject it to a referendum again.

 
Department Head Reports -
Superintendent of Water UtilitiesA motion was made by Mr. Brewer, seconded by Mr. Camp, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Wykle reported on water and sewer issues relative to the latest storm event on 9/8 and 9/9/04.
He stated there were no sewage backup problems and one pump was able to handle the water. He reported on letters to residents in the Ontario on the Lake neighborhood relative to hook ups to the sanitary sewer and he stated he believes that the corrections that were made is why there were no problems when Ontario was hit with 4.5 inches of rain.
 
Superintendent of HighwaysA motion was made by Mr. Shears, seconded by Mr. Camp, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Slocum reported on work done by his department during the recent storm. He explained how they handled drainage and road flooding problems. He also reported the new salt storage facility is almost complete and that mulch from the Landfill is available at the Highway Garage, free to residents.
 
Building Inspector/Code Enforcement OfficerA motion was made by Mr. Camp, seconded by Mr. Shears, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Camp noted there have been 49 new single family home permits issued as of 8/31/04, a total of 50 were issued in all of 2003.
 
Director of Recreation & ParksA motion was made by Mr. Brewer, seconded by Mr. Camp, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Riddell reported on summer programming. He stated the football season is off to a good start and that the fields held up real well during the heavy rain.
 
Sole AssessorA motion was made by Mr. Shears, seconded by Mr. Camp, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
There was a discussion on the process and timeframe for doing a revaluation of the town. Mr. Brewer asked Mrs. Perkins several questions on the frequency of the updates and stated we need to look at ways to communicate with the public in advance.
 
Ontario Public Library - A motion was made by Mr. Shears, seconded by Mr. Camp, to
accept the August 2004 Library report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mrs. Obaid reported an increase in circulation of 19% in the month of August. She stated they are very busy in the Library and the statistics don’t show all of the business that they are doing. The focus this month will be on obtaining a Library card that entitles you to the use of the four county library systems.
 
Ontario Town CourtA motion was made by Mr. Fillmore, seconded by Mr. Shears, to receive the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Dog Control OfficerA motion was made by Mr. Camp, seconded by Mr. Shears, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Watershed Management Advisory CouncilA motion was made by Mr. Fillmore, seconded by Mr. Brewer, to accept the August 2004 report as presented. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Tyo reported that the storms this summer have been the worst than in the last 35 years. At the last storm, Ontario was under control in just one day and surrounding areas were in a state of emergency for 3-5 days.
 
Mr. Fillmore thanked the Watershed Advisory Council for all the work they have done over the years and he added we are enjoying the pay-off for all the work that has been done cleaning out the creeks.
 
Old Business - None
 
New Business – A motion was made by Mr. Camp, seconded by Mr. Shears, to schedule a regular Town Board meeting on Monday, September 20, 2004 at 7:30 PM in the Ontario Town Hall, 1850 Ridge Road, Ontario, NY. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Fillmore, seconded by Mr. Camp, to authorize the Supervisor to execute an easement grant from Verizon New York, Inc. (former New York Telephone Company) for property at the Lake Road lift station (tax map #61119-00-928264). 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Shears, seconded by Mr. Brewer, to adopt a resolution
 
IN THE MATTER OF THE ONTARIO WATERSHED MANAGEMENT BENEFIT AREA
 
WHEREAS, by Resolution of the Town Board dated May 24, 1993, a town wide watershed management benefit area was established and has been operational since that date; and
 
WHEREAS, the Watershed Management Advisory Council has submitted a Memorandum to the Town Board requesting a change in the unit fees charged and removal of the budget cap as set forth in item 5 of the Town Board’s Resolution of May 24, 1993; and
 
WHEREAS, the Town Board wishes to review and study the requests of the Watershed Advisory Council; it is
 
ORDERED, that the Town Board of the Town of Ontario shall meet at the Town Hall located at 1850 Ridge Road, Ontario, New York on the 11th day of October, 2004 at 7:30 PM to consider a resolution raising the Watershed unit fee to $2.50 per unit and removing the $95,000.00 per year budget cap; and it is further
 
ORDERED, that the Town Clerk of the Town of Ontario is hereby authorized and directed to publish a Public Notice of such Hearing in the Wayne County Mail and to post a copy of this Resolution in the time and manner required by law. Dated 9/13/04 5 Ayes 0 Nays RESOLUTION ADOPTED
 
A motion was made by Mr. Camp, seconded by Mr. Shears, to authorize the Supervisor to execute a driveway easement between the Bank of America and the Town of Ontario for the parking lot behind the bank on the north side of Ridge Road. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Shears, seconded by Mr. Camp, to authorize the Supervisor to execute the MRB Group proposal for engineering services for an amount not to exceed $10,300.00 relative to trident filter improvements, as recommended by the Superintendent of Water Utilities in memorandum #22-2004. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to accept the lowest responsible quote for installation of recirculation pump piping, valves and appurtenances to LeClaire-Fleming Mechanical Services, Inc. for a total not to exceed $13,265.22, as recommended by the Superintendent of Water Utilities in memorandum # 24-2004. 5 Ayes 0 Nays MOTION CARRIED
 
A motion was made by Mr. Brewer, seconded by Mr. Camp, to adopt a resolution
 

BE IT RESOLVED BY THIS TOWN BOARD AS FOLLOWS:

 

(1) The firm of Bernard P. Donegan, Inc., is hereby designated financial consultant to the Town of

Ontario.

(2) Said firm shall be compensated for its service to be rendered in connection with the approximately

$5,800,000 Landfill Closure Capital Project in accordance with its proposal letter dated September
1, 2004.

(3) The Supervisor is hereby authorized to execute and deliver said proposal letter.
(4) This resolution shall take effect immediately

A motion was made by Mr. Brewer, seconded by Mr. Camp, to authorize the expenditure of $250,000.00 from the HR1 Capital Reserve Fund for the construction of an addition to the Town Hall/Library building at 1850 Ridge Road, per the plans submitted by the Building Inspector.
 
There was discussion with the Attorney on the procedure to expend funds from a Capital Reserve Fund.
Ms. Crippen stated the original (1960) and amended (1980) establishment of the town hall/library capital reserve fund was contingent upon permissive referendum but a public hearing would have to be held to use the fund.
 
Mr. Brewer amended his motion, to schedule a Public Hearing on Monday, September 27, 2004 at 7:30 PM in the Ontario Town Hall, 1850 Ridge Road, to consider the expenditure of $250,000.00 from HR1 Capital Reserve Fund for an addition to the Town Hall/Library building at 1850 Ridge Road and to direct the Town Clerk to post and publish a legal notice of public hearing. All interested persons will be heard at the time set forth. 5 Ayes 0 Nays MOTION CARRIED
 
Mr. Camp stated he would make the sketch plans available to the Town Clerk for the public to inspect.
 
Budget Transfers/Adjustments - A motion was made by Mr. Brewer, seconded by Mr. Camp, to approve the following budget transfers:
GENERAL transfer of $125.00 from A 1990.4 to A 1950.4
HIGHWAY transfer of $3,755.00 from DA 5140.4 to DA 9010.8
GENERAL transfer of $66.30 from A 5010.4 to A 5010.2
GENERAL transfer of $30,000.00 from A 909 to H-67-909
WATER transfer of $27,570.00 from F 9950.9 to F 8330.4
WATER transfer of $10,300.00 from F 9950.9 to F 1440.4
SEWER transfer of $6,764.00 from SS 1990.4 to SS 9010.8

A motion was made by Mr. Brewer, seconded by Mr. Camp, to approve the following budget adjustments:
GENERAL FUND increase 960/expense A 1420.4 $19,301.47 from 599/appropriated fund balance (Town’s portion of legal services for Ginna assessment)
GENERAL FUND increase 960/expense A 5132.2 $69,351.85 from 599/appropriated fund balance
(balance due for the salt storage facility)
 
Mr. Brewer asked for clarification on a $10,000.00 allowance for the building plans for the salt storage facility. Mr. Slocum stated he has asked the Town Engineer to look into that. After discussion on the adjustment of $69,351.85 and a payment to the contractor Mr. Brewer amended his motion and approved only one adjustment of $19,301.47. He asked that the salt facility adjustment and voucher # 2154 for Park Lane Construction be held for further clarification. 5 Ayes 0 Nays MOTION CARRIED
 
Appointments/ResignationsA motion was made by Mr. Brewer, seconded by Mr. Shears, to
appoint the following individuals to the Economic Development Committee: Roger Bellows, Dwight Critchell, Roland Heimberger and Robin Schmidt for a term beginning 9/13/04 and ending 12/31/04. 5 Ayes 0 Nays MOTION CARRIED
 
Reports by Town Board Members – Mr. Shears stated he would be meeting with the Library Board to finalize the plans with them for the addition to the town hall/library.
 
Mr. Camp stated his family used the enclosed lodge at Casey Park and he wanted to compliment Mr. Riddell on the facility. He added Ontario is lucky to have such a nice building for their use.
 
Mr. Brewer thanked Mr. Wykle and Mr. Slocum and their employees for all the extra work they have done because of the heavy rains.
 
Approval of Claims - A motion was made by Mr. Camp, seconded by Mr. Brewer, to approve the abstract of claims for the month of September 2004, including vouchers # 2050 through # 2248 except voucher #2154 Park Lane Construction ($52,476.80) held for clarification. The grand total payable is $291,152.98 and the Supervisor is authorized to issue payments for same. 5 Ayes 0 Nays MOTION CARRIED
